Terms and Conditions About Bible Videos
WITNESSETH:
SERVICE - a. The service which Faith Family Jesus, and its subsidiary company About Bible Videos shall provide to you during the term of your membership shall include:
A Monthly subscription to the About Bible Videos DVD series.
b. Refunds, Cancellation and Return of Memberships and Orders:
i. You have the right to terminate this Agreement at any time during your regular membership. You may cancel this Agreement by calling 702-771-9895, Monday-Friday, 10:30AM -4:30 PM Pacific Standard Time or writing to About Bible Videos, POBOX 26163 Las Vegas NV, 89126-0163 Attention: Membership Department. Your monthly membership fee will be automatically billed to your designated card account at the conclusion of your trial period. To assure no further monthly membership fees are billed to your account, you must contact About Bible Videos Customer Care at 702-771-9895 by 4:30 PM Pacific Standard Time a minimum of one business day before your next scheduled billing date and receive a cancellation confirmation number. You also agree that you may be billed either by Faith Family Jesus, for your monthly membership fee of 14.47 or its subsidiary company About Bible Videos. There will be a 25.00 bounced check fee for any returned payments either by check or by credit card. You agree that either Faith Family Jesus or its subsidiary company About Bible Videos will bill you this fee as well as any uncollected fees that resulted in the bounced transaction.
ii. Monthly membership fees are refundable only on the following condition: monthly membership fees were billed/charge after the membership was cancelled by About Bible Videos Customer care and the member was given a cancellation confirmation number. Any other refund requests will be reviewed by the accounting department on a case by case basis, and a refund will be granted or denied at the accounting department's discretion. A decision regarding the status of a refund request will be made within 3-5 business days from the time of request. If a refund is granted, all fees/monies will be returned to the account within 10 business days of the initial request.
Upon request to cancel a merchandise order on your behalf, or a membership on your behalf, About Bible Videos can not refund any money deposited with About Bible Videos for that order, unless the ordered product/service:
Has not yet been shipped to you;
Or the service ordered has not yet been performed for you.
In the event that the order has been processed, the shipment has been sent or performance has occurred, About Bible Videos will use its reasonable efforts to seek a refund on a case-by-case basis. Products will be deemed acceptable by you unless About Bible Videos is notified of your dissatisfaction with the delivered product within (15) working days of the time you receive it.
About Bible Videos DVD's must be returned within 7 days of purchase. Simply call a customer care representative at About Bible Videos to receive return instructions. Unauthorized or late returns may be subject to a restocking charge up to but not to exceed 15% of the product cost. To avoid a restocking charge, please return your merchandise in the original box and packing, including all the accessories and the owner's manual. Do not destroy or discard packaging for 45 days. The value of missing accessories will be deducted from the credited amount of a return.
c. About Bible Videos reserves the right to change the terms and conditions of this Agreement and any membership policies at any time without notice. About Bible Videos may cancel this Agreement upon written notice and without refund of the current-term's membership fee.
CONFIDENTIALITY-All information and software/downloads provided through About Bible Videos is and shall remain the sole and exclusive property of About Bible Videos. You shall not publish, broadcast, retransmit, or otherwise reproduce, the information or software in any medium. Any violation of this restriction is an infringement of copyright or proprietary rights in the information and software/downloads.
LIABILITY – Faith Family Jesus, and About Bible Videos shall have no liability to you as a consumer of any products or services, including, without limitation, any liability for any defective products. ABOUT BIBLE VIDEOS MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD OR INFORMATION DELIVERED OR PROVIDED TO YOU, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ABOUT BIBLE VIDEOS SHALL, UNDER NO CIRCUMSTANCES, BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ABOUT BIBLE VIDEOS LIABILITY TO YOU SHALL IN NO EVENT EXCEED THE AMOUNT OF THE ABOUT BIBLE VIDEOS MEMBERSHIP FEE.
GOVERNING LAW: ARBITRATION-This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Nevada. If there is any dispute between you and About Bible Videos, either of us may elect to have it resolved by proceeding in small claims court or by binding arbitration administered by the National Arbitration Forum, or the American Arbitration Association, under their rules for consumer arbitrations. All disputes in arbitration will be handled just between the named parties, and not on any representative or class basis. YOU ACKNOWLEDGE THAT THIS MEANS THAT YOU MAY NOT HAVE ACCESS TO A COURT OR JURY. The terms of this Section shall survive any termination, cancellation or expiration of this Agreement.
MEMBERSHIP FEE-The fee will be billed to the credit card account or debit card you authorized when you enrolled in the program, in accordance with the billing terms furnished to you upon your enrollment in the Service.
ELECTRONIC COMMUNICATIONS – About Bible Videos, at its option, may communicate with You regarding the About Bible Videos service by mail, by telephone or by electronic communications. About Bible Videos may communicate with You electronically by means of electronic mail to the email address You provide when You sign-up for the About Bible Videos service and/or postings to the About Bible Videos website. About Bible Videos may communicate electronically to You the following types of communications: Membership Terms and Conditions (including any amendments thereto), notices or disclosures regarding the About Bible Videos service, payment and billing authorizations, and other matters relating to your use of the About Bible Videos service.
RENEWALS- Unless you notify About Bible Videos that you do not wish to renew your membership, About Bible Videos will automatically renew your membership at the end of each term and bill the then-current renewal fee to the card your original membership fee was billed to, or to the card we currently have on our files without your having to do anything further.
